Please read these Terms of Service carefully before using the StartUpz Coworking Space website or Members Portal. By accessing or using our services, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Service Agreement

StartUpz Coworking Space ("StartUpz", "we", "us", or "our") provides coworking space facilities, membership plans, workspace bookings, and related services at our location in Davao City, Philippines, and through our online Members Portal.

These Terms of Service constitute a legally binding agreement between you ("Member" or "User") and StartUpz. By creating an account, purchasing a membership, or using our facilities, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Account Responsibilities

When you create a StartUpz account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Keep your account credentials confidential and not share them with others.
  • Notify us immediately of any unauthorized access to your account.
  • Be responsible for all activities that occur under your account.
  • Use only one account per person unless authorized by StartUpz staff.

StartUpz reserves the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activity.

3. Membership Plans and Subscriptions

StartUpz offers various membership plans (Student, Freelancer, Startup Team, and others) with different pricing, access levels, and benefits. By purchasing a membership:

  • You agree to pay the applicable fees for your selected plan as stated at the time of purchase.
  • Monthly memberships are billed on a monthly basis. Annual plans are billed upfront.
  • Membership benefits are non-transferable and apply only to the registered member.
  • Team plans (e.g., Startup Team) cover the number of persons specified in the plan. Additional members require a separate plan or upgrade.

4. Payment Policies

All payments are processed securely through PayMongo. By making a payment, you agree to PayMongo's terms of service.

  • Accepted Payment Methods: GCash, credit cards, and debit cards via PayMongo.
  • Currency: All prices are in Philippine Peso (PHP).
  • Refunds: Payments are generally non-refundable once a membership is activated. Exceptions may be made at the sole discretion of StartUpz management for documented extenuating circumstances.
  • Failed Payments: If a payment fails, your membership will not be activated until payment is successfully completed.
  • Price Changes: StartUpz reserves the right to change membership pricing with at least 30 days' notice to existing members.

5. Coworking Space Rules

All members and visitors using the StartUpz coworking space agree to follow these rules:

  • Respect: Treat all members, staff, and guests with courtesy and professionalism.
  • Noise: Maintain a reasonable noise level. Use designated phone call areas for extended calls.
  • Cleanliness: Keep your workspace clean and tidy. Clean up after yourself in common areas.
  • Security: Do not share access codes or allow unauthorized persons to enter the facility.
  • Equipment: Handle all equipment and furniture with care. Report any damage to staff immediately.
  • Prohibited Activities: No illegal activities, harassment, discrimination, or behavior that disrupts other members.
  • Operating Hours: Monday–Saturday 8:00 AM–11:00 PM. Closed on Sundays.
  • Guests: Members may bring guests with prior arrangement. Guest fees may apply.

Violations of these rules may result in suspension or termination of membership without refund.

6. Workspace Bookings

Meeting rooms, conference rooms, and other bookable spaces are subject to availability.

  • Bookings must be made through the Members Portal or with staff assistance.
  • Cancellations made less than 24 hours before the booking time may forfeit the booking fee.
  • No-shows will be charged the full booking fee.
  • Bookings are non-transferable to other members.

7. Intellectual Property

All content on the StartUpz website and Members Portal — including text, graphics, logos, and software — is the property of StartUpz Coworking Space and is protected by Philippine and international intellectual property laws.

You may not reproduce, distribute, or create derivative works from our content without express written permission.

8. Liability Disclaimer

To the maximum extent permitted by applicable law:

  • StartUpz is not liable for any loss, theft, or damage to personal property brought into the coworking space.
  • StartUpz is not responsible for any interruption of services due to maintenance, technical issues, or circumstances beyond our control (force majeure).
  • Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid to StartUpz in the 30 days preceding the claim.
  • We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

Either party may terminate the membership agreement at any time. Members may cancel by notifying StartUpz staff or through the Members Portal. StartUpz may terminate or suspend membership for violations of these Terms without prior notice.

Upon termination, your access to the Members Portal and coworking facilities will be revoked. Any unused prepaid membership fees are non-refundable unless otherwise required by law.

11. Governing Law

These Terms of Service are governed by the laws of the Republic of the Philippines. Any disputes arising from these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the appropriate courts in Davao City, Philippines.

12. Changes to Terms

StartUpz reserves the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by posting the updated Terms on this page. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
